Provision of services within the EU

Delegation is a process in which an employer sends its employees to temporarily perform work in the territory of another country, usually as part of a single task or project. This process is intended to enable the employee to work abroad, not necessarily permanently, in order to achieve a specific goal or project. In the case of delegating employees to another Member State of the European Union (EU) or the European Economic Area (EEA), there are specific rules and regulations that regulate this process. In short, a delegating employer must meet certain conditions, which include:

• legal employment of the employee in the country from which the employee is delegated;
• the company must conduct a significant part of its business activity in the country from which the employee is delegated;
• the employer is obliged to provide transport and accommodation to delegated employees for the duration of the delegation.

Providing services within the EU – foreigners

Countries to which the workers are delegated may have their own conditions and regulations regarding the delegation of workers from third countries. Therefore, it is always important for employers who are delegating and delegated workers to check the specific requirements of the country to which the delegation is performed. Certain issues are regulated by European Union law and national regulations.
